A first version of this message has been posted on Facebook on 26 February 2024 and this modified version has been sent on 29 February 2024 to the International Court of Justice at The Hague (ICJ-CIJ.ORG), to the United Nations, to several world leaders, to the U.S. Ambassador to the United Nations, to the Israeli, Quatar, Egypt and United States delegation meeting since 23 February 2024 in Paris to negotiate a cease-fire in Gaza, and a plan for a durable peace.

1. The Author is Not Taking the Side of Palestinians or Israelis But of ‘The Rule of Law’

The author of this document is not taking the side of the Palestinians or Israelis;

he is taking the side of ‘The Rule of Law’,

of what is right, logical, rational, scientific, fair, and what his conscience tells him is humane.

The author of this document, Dario Crosetto is urging Media outlets to broadcast this balanced and fair proposal, grounded in objective facts, photos, testimonials, and videos provided by their 83 colleagues who were killed by the Israeli IDF Military, to serve the public and other colleagues who are still risking their lives to serve us.

This would serve as a tribute to their sacrifice in providing information which portrays reality. Please broadcast the links to Crosetto’s previous documents listed above for resolving the Israeli-Palestinian conflict, based on the power of the ‘rule of law’ rather than relying on the power of the arms and bomb. This would allow them to achieve a lasting mutual respect for the right of both countries to exist in peace and security.

2. Crosetto’s Proposal: Issuing Arrest Warrants to Enforce ‘The Rule of Law’

Before the genocide of Palestinians in the Gaza Strip, before the protests of millions of people worldwide, before the sacrifice of 83 journalists who dared to provide proof of the genocide, before the sacrifice of the individual who set themselves on fire outside the Israeli Consulate in Atlanta on 1 December 2023, and before the sacrifice of the active US Air Force member who died after self-immolating outside the Israeli embassy in Washington DC on 25 February 2024 while declaring “no longer be complicit of genocide” and shouting “Free Palestine”, Crosetto embraces Martin Luther King Jr.’s message not to remain silent and indifferent about matters of importance.

Crosetto proposes a solution involving the issuance of arrest warrants based on the enforcement of “the rule of law,” a principle advocated by all countries that consider themselves to be the most civilized.

The logic to understand what is needed to issue an arrest warrant is very simple: it requires evidence such as a dead body, a missing person, damages, or any other indication that a law has been broken.

Once this information is established, prosecutors, lawyers, investigators, police officers, and judges undertake the challenging task of gathering data and evidence to identify the guilty party. After identifying the name of the perpetrator responsible for the death or damage, the court issues an arrest warrant.

Subsequently, law enforcement agencies like the police, FBI, or other government institutions are tasked with apprehending the suspect. In certain cases, such as that of El Chapo, international police agencies may work tirelessly for several years to capture the suspect and request extradition. However, it is important to emphasize that they do not resort to bombing entire populations or committing genocide for extended periods, as Israel has done in the Gaza Strip for 144 days and continues to do so.

Television programs and movies, such as ‘Dateline,’ ’48 Hours,’ ‘America’s Most Wanted,’ ‘The Act,’ ‘Anatomy of Crime,’ ‘Law & Order True Crime,’ ‘Cold Justice,’ ‘The FBI Files,’ etc., often depict this process to the public, providing clear examples of the steps required to issue an arrest warrant when evidence of a crime exists.

The most recurrent statement in these programs is the urgency to act, identifying the name of the perpetrator as soon as possible in order to issue an arrest warrant that could save other people’s life or prevent further harm.

In the case of Israel, the International Court of Justice must first formally record, under a protocol number, the irrefutable evidence of Israel’s actions supported by photos, video recordings, reports from journalists, Doctors Without Borders, United Nations operators, and official reports from Palestinian administrators.

Viewers of programs like those mentioned above, which depict the process of gathering evidence for issuing an arrest warrant, are accustomed to hearing not only the reasons that finds the investigated person culpable, but also reasons when the court decides not to issue an arrest warrant.

The public also learn when mistakes are made, when an arrest warrant was not issued, and the perpetrator killed more people and caused more damage to innocent people. This is the case of Israel, which in 100 days killed 24,000 Palestinian civilians (of whom 75% were women and children) and destroyed 80% of their houses and businesses in the Gaza Strip.

Because the International Criminal Court (ICC) of the International Court of Justice (ICJ) did not issue an arrest warrant to the Israeli perpetrators, they continue, and after 144 days, the death toll increased to over 30,000 Palestinians civilians killed, the destruction exceeding 90% of houses and businesses and starvation escalating in the Gaza Strip. On 26 February 2024, a 2-month-old child died of hunger because Israeli leaders and IDF Israeli Military forces impeded humanitarian aid and even fired on convoys of food.

3. Urgency to Stop Genocide and Starvation in Gaza Strip: The Responsibility of the International Criminal Court to Issue Arrest Warrants, United Nations to Deploy Peacekeeping forces to Gaza Strip and West Bank, and IDF Israeli Military to Evacuate Occupied Territories

It is extremely urgent that the International Criminal Court act by issuing arrest warrants to the perpetrators who are responsible of the continuing genocide of Palestinians in the Gaza Strip for more than 140 days.

It is extremely urgent the United Nations act by sending Peacekeeping forces to the Gaza Strip to protect civilians and guarantee an orderly distribution of humanitarian aid to avoid a catastrophic situation of starvation and the spread of diseases.

Who are the perpetrators? The Israeli Military IDF, their Generals, Netanyahu, his Government, or all of them?

Starting from the irrefutable fact that civilian Palestinians have been killed, the International Criminal Court, by analyzing the circumstances, photos, testimonials from journalists, doctors and bystanders, can determine who is culpable of criminal charges and to whom an arrest warrant should be issued.

For example, the fact that several people in Gaza Strip waving a white flag were killed by the Israeli IDF forces, breaking international law, also killing their own Israelis who were waving a white flag and escaped from being held hostage by the Palestinians. Was this because the IDF soldiers received the order from their Generals or Netanyahu to kill everyone, including those waving a white flag, or was it the initiative of the soldier who broke the law? In the first case, the criminal charges and arrest warrant would go to the generals and Netanyahu, while in the second case, it would go to the soldier.

Another example: journalist and Doctors without Borders reported that Palestinians were instructed to move to a place that was safe, only to have it bombed, resulting in fatalities. Which Israeli provided the information to move to that supposedly safe location, and which Israeli issued the order to fire upon it? In another account, which Israeli issued the order to fire on a convoy of food intended for humanitarian aid? Etc. These are questions that need answers.

Following are some instances of Israeli violations reported by CNN, the United Nations, and the Associated Press: “A convoy that had food on it, heading to the northern parts of the Gaza Strip. That convoy on its way in what we call the middle areas, it got hit. One of the trucks carrying supplies was hit by Israeli naval fire,” Juliette Touma, global director of communications for UNRWA, told CNN. It is one of multiple incidents where aid convoys, as well as warehouses storing aid, have been hit since the war began. …Acute malnutrition has already been identified in 16.2% of children there, above the threshold considered critical, according to the UN. Israel’s war in Gaza has driven some 80% of the population of 2.3 million from their homes. …Israeli strikes across Gaza killed at least 67 Palestinians overnight and into Wednesday, including in areas where civilians have been told to seek refuge. … The Al-Aqsa Martyrs hospital in Deir al-Balah says it received 44 bodies after multiple strikes in central Gaza, Associated Press reported. Also Wednesday, the aid group Doctors Without Borders said that two people were killed when a shelter housing staff in the Gaza Strip was struck during an Israeli operation in an area where Palestinians have been told to seek shelter.”

The International Criminal Court has also the responsibility and duty to issue arrest warrant for Palestinians who committed atrocities against Israeli civilians on 7 October 2023. It must employ the same methodology to determine whether the culpable party is the individual who committed the atrocity or their leader who gave the order.

The casualties among the military of two parties in a war is different from the civilians killed. For example, in the Battle of Gettysburg during the American Civil War, Union forces against slavery suffered 23,000 casualties, while Confederate forces supporting slavery suffered 28,000 casualties. On 7 October 2023, the Israeli IDF Military forces were able to inflict 1,000 deaths among the Palestinian military perpetrators, while they lost only 373 soldiers. However, 776 Israeli civilians were killed. For these losses, the International Criminal Court should charge the Palestinians and issue arrest warrant against them as well.

However, compared to former US President Donald Trump, who is facing 91 criminal charges, there will be a disproportion between the charges against the Palestinians for the death of 766 Israeli civilians and the charges against the Israeli for the death of over 30,000 Palestinian civilians, as well as for starvation, destruction of the houses, and genocide in the Gaza Strip.

It is likely that some Israeli leaders will have to face hundreds of criminal charges, totaling to hundreds of years of prison time, which will effectively result in life imprisonment.

4. Responses from Ms. Thomas-Greenfield, the US Ambassador to the United Nations, Have Not Yet Been Provided

Crosetto is still awaiting the answer to the question “How would you refer to your ancestors who are remembered in history for their fight for your rights and dignity?” from Ms. Thomas-Greenfield, the US Ambassador to the United Nations Who, for the Third Time on 20 February 2024, Vetoed the Ceasefire in Gaza Strip at the Security Council Resolution at the United Nations.

He remarked that the words of the US Ambassador to the UN suggest prioritizing teaching a lesson with deadly weapons to those who rebel against 76 years of repression by Israel, instead of empowering ‘the rule of law’ to determine the violations during the past 76 years. He noted the ongoing human rights violations by Israel against the Palestinians for 76 years, despite the undeniable evidence documented in numerous photos, circumstances, and testimonials, including one by King Abdullah II of Jordan, who lamented, less than two months before the 7 October 2023 attacks, that Palestinians had ‘no civil rights; no freedom of mobility’.

Crosetto also asked Ms. Thomas-Greenfield to provide an answer not just to him personally, but to the public: How would she refer to her ancestors who are mentioned in history for their fight for her right, dignity as well as for those of all people who were freed from slavery? Would she use derogatory titles when mentioning their names? Would she also disagree with Martin Luther King Jr.’s fight for freedom, with his statementfreedom is never given voluntarily by the oppressor; it must be demanded by the oppressed” his fight for civil rights, and with his words in his speech delivered on 26 August 1963: “I have a dream … that all men are created equal”.

However, if Ms. Thomas-Greenfield holds the position of Ambassador of U.S. to the United Nation, is because some of her ancestors fought for her to attain her current position where her dignity as human being is respected.

5. A Civilized World is Built on the Power of ‘the Rule of Law’ Rather Than Unchecked Authoritarianism or Possession of Deadly Weapons

If we want to build a civilized world, we must make it clear to Putin, Netanyahu and the entire world population that disagreements must be resolved by the power of ‘the rule of law’. If some rules are deemed unfair to someone, those rules need to be changed through dialogue not with the brutal force of deadly weapons.

When resolving disputes in a civilized world, victory should not be determined by financial wealth or media influence in advertisements, nor by unchecked authoritarian power or possession of the deadliest weapons. Instead, it should be earned through dialogue where logical, rational, scientific, and humane arguments prevail. When presented to 90% of people who listen to their conscience, these arguments inspire mutual respect and pave the way for a fair compromise that benefits both parties, not just one.

The International Criminal Court (ICC) of the International Court of Justice (ICJ) at The Hague, on 17 March 2023 has issued an arrest warrant for Russian President Vladimir Putin for war crimes, accusing him of personal responsibility for the abductions of children from Ukraine.

This arrest warrant sends also a message to the world that to build a more civilized world, power should be entrusted to ‘the rule of law’ agreed upon by countries, leaders, and inhabitants who have sworn allegiance to their Constitution, rather than to the deviant idea of one or a few people aspiring to oppress others by achieve authoritarian power through deadly weapons.

Although South Africa had given strong hints that it would not arrest Putin if he attended the 22-24 August 2023 BRICS meeting, to avoid placing countries in a difficult situation, Putin sent his Foreign Minister, Sergey Lavrov to the meeting. The difficult situation would have arisen because South Africa is a signatory of the Rome treaty that formed the International Criminal Court and therefore has the obligation to arrest the Russian leader if he sets foot on South African Territory.

6. The International Criminal Court (ICC) has the Responsibility and Obligation for Comparing Netanyahu’s Actions with International Law Violations

Because Netanyahu has made many public statements that he aspires to oppress and destroy other countries  and he implemented his theory in practice with the genocide of the Palestinians in the Gaza Strip for 144 days and continue to do so, even threatening for several days to send tanks and Israel IDF forces to a camp of 1.4 million refugee in tents in Rafah, where he previously told them to go as a safe place. He has been consistent with his hard line for many years in supporting the actions of Israeli settlers in the West Bank, oppressing Palestinians and violating laws and agreements. It is the responsibility and obligation of the International Criminal Court to compare Netanyahu’s actions with international rule of law and explain to the public. as they did for the actions of Putin, which ‘rule of law’ he and other leader of Israel are violating.

Crosetto is a scientist with the discipline in being logical and rational in understanding the laws of nature, which help in finding logical and rational solutions to other problems, but he does not have the knowledge of all articles of the laws as attorneys and judges of the International Criminal Court may have, who can identify and point out for evaluation. Crosetto can only refer to what he reads on public information, such as the statement by the United Nations defining Genocide as: ‘entire nations, and ethnic and religious groups, had been destroyed’ and use his common sense and what his conscience tells him is right or wrong, humane and inhumane. However, what is the definition of ‘genocide’ in the articles of the international law?  By looking at Photos of the Gaza Strip, his eyes see that the entire nation of Palestinians has been destroyed. Therefore, the professional work of the attorneys and judges of the International Criminal Court is needed to address properly this issue.

An arrest warrant for Netanyahu or other Israeli leaders linked to a violation of some articles of laws, would put him in the same position as Putin, risking arrest when travelling to a country that is a member of the International Criminal Court (ICC). Furthermore, it would be educative to the world, sending the message that ‘the rule of law’ has power in a civilized world, not ‘the deadly weapons’. It would also clarify that the negotiation of borders between Israel and Palestine in a two-State solution should not be determined by the power of the deadly weapons that Israel receives from the US, but by learning from the 76 years history what it was unfair, correcting it to be is fair and right for both countries, not just for one.

7. Inconsistencies and Failure of Netanyatu’s Theories and Actions: Damaging not only the Oppressed with Genocide but also Fueling Antisemitism Against Jews and Strengthening the Movement he Intended to Destroy

Sooner rather than later, the world should realize that Netanyahu theory, practice, and actions to destroy a movement and a country is insane, illogical, irrational, illegitimate, and inhumane. It is propelling a broader Third World War conflict, showing itself to be a failure, hurting not only Palestinians, but many people in the world, including Jewish individuals, leaving them with a heritage of paying a bill to reconstruct all what they have destroyed in the Gazza Strip. They will have to deal with an increased movement that he wanted to destroy and with increased antisemitism that he fueled with his inhumane genocide actions.

Just like Putin who wanted to achieve the goal of stopping NATO from expanding, and whose actions provoked the opposite, resulting in Sweden and Finland joining NATO, Netanyahu’s goal to dismantle a movement had the opposite result of expanding and motivating the movement for more antagonism to Israel and fueled antisemitism. Netanyahu’s genocide actions have been insane and inhumane, as evidenced by his latest idea to move tanks and IDF Israeli armed forces to a 1.4 million Palestinians refugee camp in Rafah, where he had previously told them to move because it was a safe place. The Jewish community must stop him, ask for his resignation immediately to avoid creating more damages to them and to Israel, or the United Nations should propose sanctions against Israel.

It is sad and disheartening to see the reality that US is not giving arms to Ukraine to defend themselves from the invader but is giving arms, bombs and $14 billion to Israel, which is the aggressor, invading another country and committing genocide. Crosetto hopes that the “Good People” would open their eyes, would not remain silent and indifferent, but will take responsibility and express what their conscience tells them is right or wrong, humane or inhumane.

8. A Logical and Rational Working Plan for a Lasting Israeli-Palestinian Peace

In this case, a logical, rational working plan for a durable peace should consider the following points:

  1. Immediate CEASEFIRE: Initiate an immediately ceasefire in Gaza Strip and the West Bank to halt further violence and loss of lives.
  2. Withdrawal of Israeli IDF Forces: Israeli IDF forces should evacuate the Gaza Strip and West Bank immediately to reduce tensions, pave the way to peaceful negotiation and to allow to deliver humanitarian aid to Palestinians.
  3. Prisoner exchange negotiation: Israeli and Palestinian delegations in charge for negotiations in Paris should find and agreement to swap the 138 Jews hostages of Hamas with the 7,000 Palestinians in the Israeli prisons.
  4. International Criminal Court duty to issue arrest warrants: The International Criminal Court should issue arrest warrants to every Jewish and Palestinian individual, including the IDF Israeli forces and their leaders, who have broken the law, and they should be judged by the International Court of Justice
  5. Deployment of UN Peacekeeping Forces: Peacekeeping United Nations forces should be deployed to the Gaza Strip and the West Bank to protect civilians from looting and violence.
  6. Humanitarian aid distribution: Humanitarian aid should be organized to alleviate the famine suffering of the Palestinians.
  7. Commitment to comply with International law: Israeli and Palestinian delegations should accept and comply with the international laws regarding the independence and sovereignty of each country, as well as respect the borders.
  8. Negotiation of borders: Israeli and Palestinian delegations should negotiate the most difficult issue of defining the borders and determine reasonable, considerate compensations for what has been destroyed in both countries.
  9. Reconstruction efforts and plan: Israeli and Palestinian delegations should address the reconstruction of the Gaza Strip houses and business destroyed by the Israeli and agree on the payments plan.

There are people in the Gaza Strip who are suffering, starving and dying, people who set themselves on fire outside Israeli embassy in Washington DC, while declaring he will “no longer be complicit in genocide”.

Embrace Martin Luther King Jr.’s, message not to be silent and indifferent about things that matter, express your agreements or disagreements with the content of the following four letters aimed not only to achieve a ceasefire in the Gaza Strip but to give a chance for a future to the Palestinians and share them on the social media and with your contacts.
